1. Acceptance of Terms
By downloading, accessing, or using FormulaMind, you agree to these Terms of Use. If you do not agree, do not use the app.
These Terms are between you and Xuemei Ye (operating as Novarynix), the provider of FormulaMind.
2. Educational Use Only
FormulaMind is an educational formula learning app. It is intended to support study, practice, review, and general learning. It is not a substitute for professional instruction, school requirements, independent verification, or expert advice.
3. No Warranty of Correctness
FormulaMind may include formulas, explanations, examples, calculations, generated content, or practice material. While reasonable care may be taken to improve quality, FormulaMind does not guarantee that any formula, answer, explanation, or result is complete, current, or error-free.
You are responsible for checking important work against trusted sources, course materials, instructors, standards, or professional references before relying on it.
4. User Responsibility
You are responsible for how you use FormulaMind and for complying with applicable school policies, academic integrity rules, platform rules, and local laws. You should not submit FormulaMind output as your own work when doing so would violate academic or professional rules.
5. Subscriptions
- Subscription name: FormulaMind Membership.
- Plans: FormulaMind Membership is offered as a monthly plan and an annual plan with a 7-day free trial.
- Length and price: subscription length, trial availability, and price are shown on the in-app paywall and on the App Store listing prior to purchase.
- Payment: payment is charged to the user's Apple ID at confirmation of purchase after any applicable free trial ends, unless the user cancels before the trial ends.
- Auto-renewal: FormulaMind Membership is an auto-renewing subscription through Apple. It renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge: renewal charge occurs within 24 hours prior to the end of the current period at the published renewal price.
- Manage or cancel: users can manage and cancel subscriptions in iOS Settings → Apple ID → Subscriptions, or at https://apps.apple.com/account/subscriptions.
- Billing and refunds: billing and refunds are handled by Apple under App Store policy. Mandatory local consumer rights, including EU/UK statutory rights, are not waived.
- Price changes: users will be notified and given the option to accept or cancel before the new price takes effect, as required by Apple's rules and applicable law.
- Restore Purchases: available from the paywall footer and the Settings → Membership screen.
- Free trials: the monthly and annual plans include a 7-day free trial unless the App Store listing or in-app paywall states otherwise. Free trial eligibility is managed by Apple and may vary by Apple ID, region, prior use, and App Store rules.
6. iCloud Sync
Members may enable iCloud sync via Apple CloudKit. Learning data is stored in the user's private iCloud container.
Sync availability depends on the user's Apple ID, iCloud account status, network connection, device settings, and Apple's service availability. FormulaMind is not responsible for iCloud outages.
7. Acceptable Use
You agree not to misuse FormulaMind or related services. Prohibited activity includes:
- Attempting to disrupt, reverse engineer, overload, or compromise the app or its infrastructure.
- Using the app for unlawful, harmful, deceptive, or abusive purposes.
- Copying, scraping, or redistributing app content in a way that violates intellectual property rights or platform rules.
- Interfering with another user's access, security, or learning experience.
8. Availability and Changes
FormulaMind may be updated, changed, suspended, or discontinued at any time. Features, content, platform integrations, and availability may vary by app version, device, operating system, region, subscription status, iCloud availability, or operational requirements.
9. Intellectual Property
FormulaMind, including its app design, branding, text, graphics, educational materials, and software, is protected by intellectual property laws. Except for rights expressly granted by the app store or these terms, no ownership rights are transferred to you.
You may use FormulaMind for personal educational purposes. You may not reproduce, resell, or commercially exploit FormulaMind content or software without permission.
10. Apple-Required Acknowledgments
- These Terms are between the user and FormulaMind only, not Apple.
- FormulaMind, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, the user may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
- FormulaMind, not Apple, is responsible for product claims, including product liability, legal or regulatory compliance, and consumer protection claims.
- FormulaMind, not Apple, is responsible for investigating and resolving any third-party intellectual property claims.
- The user represents that they are not in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against the user upon acceptance.
11. EU / UK Consumers — Right of Withdrawal
For digital content delivered immediately, any statutory withdrawal right is lost only where the consumer expressly consented to immediate delivery and acknowledged that this would cause loss of the withdrawal right, and only to the extent permitted by mandatory local law.
12. Disclaimer of Warranties
FormulaMind is provided "as is" and "as available" to the fullest extent permitted by law. No warranty is made that the app will be uninterrupted, secure, accurate, compatible with every device, or free from defects.
13. Limitation of Liability
To the fullest extent permitted by law, FormulaMind and its operators will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for losses related to academic outcomes, incorrect answers, data loss, service interruption, subscription issues handled by Apple, iCloud outages, or inability to use the app.
Nothing in these liability limits excludes or limits liability that cannot be excluded or limited under applicable law.
14. Termination
Access to FormulaMind may be suspended or terminated if you violate these terms, misuse the app, create security or operational risk, or if continued operation is no longer commercially or technically practical.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of <STATE>, United States of America, excluding conflict-of-law rules to the extent permitted.
Nothing in these Terms limits mandatory consumer rights in the user's country of residence.
16. Standard Closing Clauses
Severability
If any part of these Terms is found unenforceable, the remaining parts will remain in effect.
Entire Agreement
These Terms are the entire agreement between you and FormulaMind regarding use of the app.
No Waiver
Failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment
FormulaMind may assign these Terms. You may not assign these Terms without FormulaMind's consent.
Notices
Notices are effective when posted to /formulamind/terms/ or sent to the user's registered email, if any.
17. Future Updates / Changes
These terms may be updated as FormulaMind evolves. Material updates will be reflected by changing the date above and publishing the revised terms at /formulamind/terms/. Continued use of FormulaMind after an update means you accept the updated terms.
